Global Surf Travel Pty Ltd (‘the Company’)

Global Surf Travel (ABN 70 083
338 649) shall be known as the 'the Company' in the conditions below.
The following Terms and Conditions apply to current booking/s and supercede
all other Terms and Conditions printed on passengers' statements. You
are deemed to have read, understood and accepted the following booking
and tour Terms and Conditions. Please check addendums to these Terms
and Conditions, if any, upon booking. |

Tour Price Includes
|
Your tour price includes airfare,
accommodation, transfers (if any) and meals (if any), as specified in
the tour brochures, itineraries and booking form. |
|
Tour Price Exclusions
|
Your tour price excludes fuel tax,
airport tax, airport security tax, airline insurance charges, visa fees,
travel insurance, customs user fees as specified by the airline and airport
authorities, laundry, excess baggage charges, beverages, room service,
gratuities to drivers and tour leaders/tour guides and tips to hotel
porters, and all items of a personal nature. |

Travel Insurance
|
You are strongly advised to purchase
insurance coverage with respect to tour cancellation or curtailment,
accident, injury, illness, medical and hospitalization, flight delays,
baggage lost, etc. Our staff will be pleased to assist with enquiries
of any travel insurance. Under no circumstances is our company to be
constructed as a carrier under contract for safe carriage of the passenger
or his/her baggage and belongings. |

Reconfirmation of Flight
|
It is the passenger's responsibility
to reconfirm all outgoing flights at least 72 hours prior to departure.
Global Surf Travel is not responsible for any cancelled flights by the
respective airline. |
|
Accommodation
|
Accommodation is as specified in
the package brochure and/or the booking form. Accommodation for adults
is based on sharing twin or double bedrooms at the nominated or similar
standard overnight. Because of the unique nature of some packages. the
sharing of bathroom facilities may be necessary. |
|
Amendments to Flights
|
The air ticket issued is a special
ticket issued to the specified airlines only. It is non-negotiable, non-endorsable,
non-reissuable, non-refundable and not re-routable. A minimum charge
of A$ 100 per ticket will be levied for any amendment of air tickets
once issued, but subject to airlines conditions. Any alterations of the
routing or change of date by the passenger is solely at his own risk.
No refund will be made for any unused portions of the air tickets. At
times, passengers may request for a change in the returning flights to
a later date. This is subject to the airlines' conditions, ticket validity,
additional charges and seat availability, etc. Any additional charge
imposed by the airline will be borne by the passenger. For tours operated
on chartered flights, no extension/deviation is permitted. |

Amendments to Bookings (request by passenger)
|
For any changes in the departure
date or tour type, cancellation charges apply as spelt out under the
section 'Payment and Cancellation Charges' |
|
Amendment to Tour Itinerary by the Company
|
The company makes reasonable effort
to avoid changes in itinerary. However, the company reserves the right
to make minor changes at any one time without compensation and without
any prior notice. |
|
Cancellation Notice and Cancellation Fee and Right to Reject
|
Cancellation of confirmed bookings,
at your request, must be made in writing to avoid misunderstandings and
received by the Company to be effective. The charges in the preceding
paragraph apply. The Company reserves the right withdraw any itinerary
or any bookings made by a client or decline or refuse any person as a
member of the tour before the commencement of the tour, if it appears
to the Company that any such person is likely to endanger the health
or safety, or impair the comfort and enjoyment of others on the tour.
In any of the foregoing events, the Company's sole liability shall be
limited to a refund on tour fare paid. |

Cancellation of Tour by Company
|
At times, due to low subscription
of a particular tour, the company may choose to cancel the entire tour.
The company may, if it chooses, recommend alternative tours, preferably
to the same destination, or other tour to you. Should you decide not
to accept the alternatives, all refunds will be paid to you within a
month. |
|
Extensions and Deviations
|
Extension of stays and/or deviations
may be permitted at the end of the tour, subject to the maximum validity
and restrictions of the air ticket, seat confirmation and availability
of accommodation prior to commencement of tour. It is the passengers'
responsibility to hold firm confirmation for his return flight. When
the extension of stays and/or deviations cannot be confirmed two weeks
prior to the group's departure date, passenger is deemed to be taking
the original tour schedule. All extra cost incurred to process the extension,
e.g., administration fees, will be borne by the tour member. Please note
that extensions of stays and/or will be at passenger's own expense and
transfers to and from the airport will not be provided. |

Modes of Payment
|
Payment may be made by credit card,
direct debit and cheque. Cheques will only be accepted by the Company
at least 21 working days before the scheduled tour departure. There will
be an administrative fee of AU$200 to be charged for all return cheques.
An interest of 2% per month will be levied for all outstanding amounts.
In a situation where a defaulted cheque occurs, alternative payment must
be made by credit card or direct debit only. Global Surf Travel reserves
the right to cancel your bookings. Title of package, ticket, accommodation
does not belong to the passenger until good payment is made. |

Applicable Law
|
| The law applicable to this agreement will be the law
in the Australian State of Queensland, AUSTRALIA. |
|
Deposit
|
Ticket/Package on Daily Charter Flight Tours and Overnight
Plus Charter Flight Tours
A 50% deposit is required at time of booking your chartered flight tour,
with a minimum of 14 days notice to be given for Daily Charter Tours.
A 50% deposit is required at time of booking your chartered flight tour,
with a minimum of 21 days notice to be given for tours that include Overnight
Plus Charter. |

Payment & Cancellation Charges
|
In the case of Daily Charter Flight
departure, Full Payment is required 7 days prior to departure. In the
case of Overnight Plus Charter Flight, Full Payment is required 14 days
prior to departure. Failure to comply with this may result in cancellation
of your tour booking and in such an event, the cancellation fees as stated
below are payable by you. Cancellation fees may vary during peak holidays
(public holidays, day before and after public holidays, etc.,). Terms
below apply only to tour packages operated by the company. For tour products
or individual components supplied by third party(ies) and other air tickets,
train services, accommodation bookings, etc, the cancellation charges
under the Terms and Conditions of the third party(ies) shall apply witha
handling charge of A$ 50 per service per passenger. Cancellation charges
of the third party(ies) will include no-show fee, refund administrative
fee, and any deposit committed to their suppliers to secure the confirmation
of the services requested. |

If the number of days between departure and receipt
cancellation notice for Daily Charters is:-
6 days and less non refundable
Between 7 and 13 50% refundable
14 days and over 100% refundable
If the number of days between departure and receipt cancellation notice
for Overnight Plus Charters is:
13 days and less non refundable
Between 14 and 20 days 50% refundable
21 days and over 100% refundable |

Responsibility & Liability
|
Where the company has not seen
negligent nor in breach of any duty, they assume no responsibility for
injury, damage, accident, loss, delay, or irregularities that may be
caused to persons or property, where such occur as a result of circumstances
beyond their control. The Company is an agent of airlines, transport
companies, etc, and is not liable for changes made by suppliers but will
render assistance wherever possible. All tickets, coupons and orders
are furnished and issued subject in all respects to those Terms and Conditions
under which the means of transportation or other service provided thereby
are offered or supplied by owners, operators, public carriers managing
agents or agents. The company will not be responsible or liable for (damages,
refund or otherwise) for: a. Mechanical breakdowns (except where it is
due to negligence on the part of the company or its agents), government
actions, weather, act of God, strikes compulsory quarantine or other
circumstances beyond it's control. b. The failure of the client to obtain
required documentation (e.g. health certificates, visa, passports etc).
c. The failure of the client to follow reasonable instructions including
but not limited to check-in and check-out places and times. Any liability
of the Company for breach of any provision of, or any term implied by
the Trade Practices Act 1974 (Cth) or equivalent State legislation whose
operation cannot be excluded, is limited to the extent possible, at the
option of the Company, to re supply the service or payment of the cost
to have the services supplied again. |

Acknowledgement, Indemnity and Release of Liability
|
The purchase of services from the
Company is acknowledgement that you have read and understand all information
contained within these Terms and Conditions including all Terms and Conditions
outlined within this clause. You acknowledge and agree:- that the tour
activity that will be conducted will expose you to the risk of serious
injury including possible death. You will comply with all of these Terms
and Conditions, that all information provided by you in these Terms &
Conditions are true and correct, that you are prepared to participate
in the tour notwithstanding the risk of injury, death or property damage
whilst participating in the Tour.
It is a condition of your acceptance to participate in the tour that
you release and indemnify the Company, in that, you release and indemnify
the Company and agree to keep the Company indemnified in respect of all
loss, damage, consequential loss and damage, claims, demands, proceedings,
actions, claims by you against the Company or any liability for death,
personal injury or property damage, or any other loss suffered by you
howsoever caused whether that loss, damage or otherwise is caused out
of any act, default or omission on our part or on the part of our employees,
servants, agents, invitees, licensees, subcontractors or consultants.
You further acknowledge that “claims” includes any actions,
suits, causes of action, demands, debts due, cost and expenses and other
liabilities of any nature whether present, future or contingent, including
but not limited to a claim arising from a negligent act or omission by
the Company, its employees, servants, agents, invitees, licensees, subcontractors
or consultants. |

Passports and Other Travel Documents
|
It is the passenger's responsibility
to ensure that they have a valid passport with a minimum of 6 months
validity from the date of departure. Relevant visas and vaccinations
may be required. You must have the necessary visas, vaccinations, health
certificates and all necessary travel documents as required by the various
government authorities of the countries to be visited (e.g., exit permit,
work permit, social visit pass, etc). |

Visa
|
Please check with us regarding
visa requirements. Service fee applies for any visa application. If visa
application is rejected by embassy, the service fee is non-refundable.
Different embassies/consulates require varying lengths of time to process
visa applications. If you are not a Singapore Passport holder, please
forward your passport to us as early as possible for visa applications.
We render assistance in making visa applications, whenever possible.
The company cannot, however, guarantee the approval of your visa application.
This service is subject to auxiliary charges. (Please check with our
staff for the amount). In the event of the lost of passport(s) in the
process of Visa application, Global Surf Travel's liability is restricted
to the replacement of the passport only. If, for any reason, your application
for visa or exit permit is rejected, a full refund of all monies paid
(excluding visa application fees paid to the respective embassies) will
be made if the result of the rejection is made known to the company at
least 35 days prior to your departure. If less than 35 days notice is
given, the relevant cancellation charges as stated under the section
'Payment and Cancellation Charges' and/or in the addendums to these Terms
and Conditions, if any, will apply. The company cannot be held responsible
for any expenses, reimbursements or refund of any tour costs if the passenger
is deported or refused entry by Immigration Authorities on the tour for
whatever reasons, including improper travel documents, quarantine, customs
regulation, possession of unlawful items or irregularities that may cause
harm/damage to persons or property. |

Special Requests
|
If there are any special requests
regarding special meals, dietary requirements, adjoining rooms etc, feel
free to inform us when booking. Such requests are subject to confirmation,
surcharge and availability. |
|
Transfer of Booking
|
Global Surf Travel is not obligated
to transfer booking out to another agent. If the customer requires Global
Surf Travel to do so, a service charge will apply. |
|
Unused Services
|
No refund will be made in respect
to accommodation, meals, sightseeing tour or any other services which
are included in the tour fare but not utilized by the tour participant,
either in part or full, or where passengers amends, cancels or otherwise
varies arrangements after commencement of the tour. |
|
Refunds
|
Refunds will take a period of 2
months to process. Value of refund and amount to be refunded is subject
to the discretion of the airline / tour operator. It is also subject
to cancellation and administrative charges by Global Surf Travel / Airline
/ Tour Operator. In additional to the airlines / tour operator cancellation
& refund charges, Global Surf Travel will levy an administration
fee of A$ 30 per person. |
